The Former President's System of Consequences and Incentives

The ex-president's intense desire for retribution has quickly transformed into a structured apparatus. Over the past year, the president's rage and whims have assumed the form of administrative measures similar to reminiscent to past authoritarian systems. Federal personnel who fail to comply are summarily dismissed and replaced by supporters. Opposing leaders who challenge him risk prosecution, court proceedings and sanctions. Critics have been labeled under administration directives as “unpatriotic”, “opposed to religious values” and “opposing economic freedom”, and threatened with legal action as “security threats”.

Government Institutions Remade

Every instance involving targeting of critics and leniency for his allies demonstrates its own unique qualities. However, despite their specific nature, they embody examples of what has emerged as a deliberate method. Those incidents are far from coincidental. The administration's cleansing of Department of Justice lawyers and law enforcement agents, alongside his installation of supporters in senior roles, started swiftly, promptly assumed a regularity, and has now been shaped into a structure. Federal prosecutors and the FBI have been transformed into political organizations under Trump's direct command to implement his wishes. Unfairness has been rendered routine. It constitutes the system of punishment.

Leadership is more concerned with penalizing the chief's perceived adversaries than they are with safeguarding our public welfare.

Internal the Structure

The beginnings of this mechanism has been uncovered in the legal complaint of three former high-ranking Federal Bureau agents filed in September in the judicial system in the capital against agency head an administration figure and top lawyer a key figure for wrongful dismissal in “a campaign of revenge against Plaintiffs for what administration figures judged to be a refusal to exhibit adequate allegiance”. According to the filing that one official, the previous temporary head, recounts a conversation in which he “freely acknowledged the unlawfulness of his behavior”.

Driscoll had attempted to shield FBI agents from being fired, the filing claims. He informed him that “White House figures” – perceived by the official to be the presidential administration and DoJ – had directed him to fire anyone who they determined as having been involved in a criminal investigation against Trump. The document continues: “Patel stated that he had to terminate the individuals his leaders told him to dismiss, because his chance to retain his own role depended on the removal of the officials who were involved in investigations involving the President. The director noted that there was no option he or the official could do to stop these or any other dismissals, because ‘the agency attempted to incarcerate the President in jail and he hasn't forgotten it.’” When he informed the director he was disregarding the FBI's own regulations, Patel reportedly said “he understood that and he realized the character of the swift terminations were probably illegal”.

Broad Impact

Following the director's claimed admission to Driscoll, the Department of Justice and the FBI have been gutted and repurposed for his retribution system. Six of the FBI's top officials were terminated or pushed out in the early weeks of the administration. About thousands of lawyers at DoJ have accepted a “deferred resignation program”. No fewer than multiple government attorneys, among them those in the Manhattan division, stepped down in objection over what they viewed as partisan influence in withdrawing the criminal prosecution against the New York City mayor, the mayor, in exchange for his assistance with the administration's federal agency detentions of migrants. The public integrity section of the justice department, which handles corruption cases, has been cut down to minimal staff. The civil rights division has been decimated: 70% of its employees has departed. A third of executives at DoJ have resigned. The division implementing ecological regulations has experienced the exit of half its leadership.

Incentives and Sanctions

Concerning the legal matter, the interim prosecutor for the southern district of New York, the official, stepped down in dissent against what she characterized as the “exchange”. The border official, Trump's “enforcement chief,” appeared as the enforcer with him on a media outlet to announce: “Should he fail to deliver, I will return in the city.”. And, a former official, earlier the acting deputy attorney general and a former Trump attorney, who brokered the deal, was given an court role, a potential pathway to the judicial branch.

Trump's protection for wrongdoings committed while in power, awarded by the remarkable ruling of the conservative on the judicial body, thus blocking his criminal case over the Capitol riot and preserving his electoral prospects for the presidential race, is the basis on which he relies to protect his stalwarts. Given this protection, he has been freed to enable misconduct. The impact of the judicial ruling saturates his presidency and the GOP thoroughly. The legal case has metastasized. In the words of the former president's White House counsel John Dean commented about the Watergate
